What obligation do I have to a car dealer concerning not following through with purchase of a new auto?
I have recently decided to purchase an 07 Xterra. I have yet to pay for the car. I have filled out a lot of papers such as a "you owe/We owe, a power of attorney concerning title transfer and some other ones. The car i chose is not at the lot. They promised me the car the following day, but three days later no car. They stated that they were having difficulty with another dealership and they had drop the ball. They even said that they were going to drive the car approx 300 miles to my location. I stated that would not be acceptable. There customer service has been quite lame. I had to call them to find out the status of my vehicle. I placed no money down and gave them no sort of retainer. They also wanted to run another credit check after I stated that I have a blank check from my bank. Can I ditch this loser dealership?
If you don't have the car in your posession, you don't own the car...the paperwork means nothing if you don't have the vehicle. When they have you sign all that stuff, they just want you to feel committed, but you're not comitted to a thing until you drive the car off the lot. Then, it is yours no matter what.
BTW, there is no such thing as a 3 day right of recision in car deals like that other guy said; just a myth. Once you take it home, it's yours, but not until you take it.
